Terms and Conditions of Sale
Preamble
Site ownership: the site is entirely owned by ruike.fr, as well as all related rights. Any reproduction, in whole or in part, is prohibited without the express prior authorization of ruike.fr.
1. Acceptance of the general terms and conditions of sale
The customer acknowledges having read, prior to placing an order, the general terms and conditions of sale set forth on this screen and expressly declares to accept them without reservation. These general terms and conditions of sale govern the contractual relationship between ruike.fr and its customer. They shall prevail over all other conditions appearing in any other document, unless ruike.fr expressly provides a prior written derogation.
These general terms and conditions of sale may be modified at any time by ruike.fr, without prior notice. The applicable conditions will be those in force on the site at the time the order is confirmed.
2. Order
Automatic registration systems are considered as proof of the nature and content of the order. ruike.fr confirms the acceptance of its order to the customer at the e-mail address provided by the customer. The sale will be concluded from the validation by ruike.fr of the payment of the order, i.e. the date of validation of payment for orders paid online by credit card or the date of receipt of payment by bank transfer or cheque. ruike.fr reserves the right to refuse or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.
3. Price and payment
The price is expressed in Euros and includes all taxes.
The price indicated on the product sheets does not include transport.
The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for France and EEC countries. This price includes the price of the products, handling, packaging and storage costs of the products, transport, insurance and commissioning costs.
The price is payable in cash, on the day of order confirmation.
Payment is made:
-by credit card (CIC-Monetico).
-by Paypal
Payments made shall not be considered as deposits. Any delay in payment automatically entails the immediate payment of late interest corresponding to one and a half times the legal interest rate.
4. Retention of title clause
By express agreement, and in accordance with the provisions of the law of May 12, 1980, the products ordered remain the property of ruike.fr until full payment of their price by the customer. In the event of non-performance of its obligations by the customer, whatever the cause, ruike.fr shall be entitled to demand the immediate return of the products at the customer's expense and risk.
5. Product availability and shipment
Delivery from mainland France by tracked Colissimo:
-To mainland France 48 hours (2 working days)
-Outside mainland France 4 to 8 days
All deadlines announced on the ruike.fr website are in working days (excluding Saturday, Sunday and public holidays). Each product sheet indicates:
-Either the presence of the product in stock: the indication "in stock" corresponds to the stock status at ruike.fr at the time of the order.
-Or the mention "out of stock": the product is temporarily unavailable from our suppliers.
Orders are processed, prepared and shipped, i.e., handed over to our carrier, within 24/72 hours from:
-The receipt of the product by ruike.fr, for products in stock,
-The validation of payment by the customer when made online by credit card or the receipt of payments made by bank transfer, for products in stock at the time of this validation or receipt,
-The receipt of products by ruike.fr, when they become actually available from the supplier, for pre-ordered products.
Generally, orders are processed after payment validation when paid online by credit card or upon receipt by ruike.fr of payment when the customer has chosen payment by bank transfer or cheque. The "in stock" indications and availability times are subject to change between the order date and, as the case may be, the date of credit card payment validation or the date of receipt of the bank transfer or cheque. Availability times are also subject to change at the initiative of the supplier and/or manufacturer.
In such cases, availability times will be those in force at the time of credit card payment validation or at the time of bank transfer receipt.
In case of unavailability of products from our suppliers:
-permanent unavailability: ruike.fr undertakes to offer the customer replacement items or to refund the missing items, without delay and at the latest within 30 days in accordance with the provisions of Article L121-20-3 of the Consumer Code.
-temporary unavailability: ruike.fr informs the customer of the date on which the product will be available again. The customer then has the option of maintaining their order with these new deadlines or cancelling it. In the latter case, ruike.fr undertakes to refund the missing items without delay and at the latest within 30 days in accordance with the provisions of Article L121-20-3 of the Consumer Code. Shipments to DOM-TOM will be made subject to acceptance of the package in the hold.
6. Delivery
Orders are delivered by independent service providers of ruike.fr within the deadlines announced by these service providers. The deadlines announced by these service providers are usually 48-72 hours for packages under 30kg and more than 72 hours for packages over 30kg.
To report any delivery difficulties to ruike.fr, the customer has free online order tracking, accessible via the order details.
ruike.fr undertakes to do what is necessary to ensure that orders are delivered within 30 days of validation of online credit card payment or receipt of payments by bank transfer. The carrier, for its part, undertakes, by contract with ruike.fr, to deliver the order to the buyer's address provided by ruike.fr.
In addition, for deliveries outside mainland France, the customer undertakes to pay all taxes due on the import of products, customs duties, value added tax, and all other taxes due under the laws of the country of receipt of the order. All orders placed with ruike.fr are for the personal use of customers; customers or recipients of the products are prohibited from any partial or total resale of the products. ruike.fr cannot be held responsible for the non-payment of taxes for which the customer is liable.
In mainland France, delivery will be carried out by La Poste via Colissimo tracking or TNT. In EEC countries, deliveries are carried out by La Poste via Colissimo tracking Europe or Chronopost or TNT. Deliveries outside the EEC are carried out by international postal services or Chronopost or TNT. For reasons of availability, an order may be delivered in several parts.
Regardless of the delivery location, delivery is made within the time slot agreed with the customer by direct handover of the product to the announced recipient, or in the event of absence, to another person authorized for this purpose by the customer. In the absence of any recipient, a delivery notice is left at the delivery address. Any new presentation costs are at the customer's expense. The customer is obliged to check the condition of the products upon receipt. In the event of damage, they must precisely state their reservations on the delivery note, and reiterate them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery in accordance with the provisions of Article L.133-3 of the Commercial Code. They must also inform ruike.fr by registered letter with acknowledgment of receipt of any damage due to transport within eight (8) days following receipt. No claim will be accepted in the event of non-compliance with these formalities.
ruike.fr will, in any event, be released from its obligation to deliver in the event of:
-the occurrence of a case of force majeure such as, in particular, war, riot, fire, strikes, accidents and the impossibility of being supplied,
-non-performance by the customer of any of their obligations (payment of the price, accuracy of the information communicated by the customer such as the delivery address...)
7. Warranty
All technical items benefit from a minimum one-year contractual warranty from the manufacturer. Some are guaranteed for 2 years or more (see the description of each item). Warranty extensions are only valid in Metropolitan France and Corsica.
Any return must be preceded by the prior agreement of ruike.fr and the assignment of a return number, as well as confirmation of the return address.
In the absence of prior agreement, assignment of a return number, or in case of shipment to any other address confirmed by ruike.fr, the goods will be returned to the customer with shipping costs due. Returned products must be accompanied by their original packaging.
In any event, the customer benefits from the legal guarantee against hidden defects (Articles 1626 et seq. of the Civil Code). Provided that the buyer proves the hidden defect, the seller must legally remedy all consequences (Articles 1641 et seq. of the Civil Code).
Excluded from all warranty are:
1.Uses and maintenance not in conformity with the user manual provided with the product, as well as defects in use or maintenance.
2.Damage due to improper handling, connection (whether carried out with original accessories or with other accessories substituted by the customer), abusive or abnormal use, intentional or accidental physical modification, use for professional or commercial purposes.
3.Spare parts or accessories whose replacement results from their normal wear and tear, or from routine maintenance operations: bulbs, batteries, seals, etc...
4.Transport and modification costs of the appliance, in case of recall by the manufacturer for a series defect.
5.Damage due to an external event (lightning, water damage, etc...).
6.Interventions carried out on the appliance by any person not mandated by the After-Sales Service, as well as malfunctions and damage resulting from such an intervention.
Conformity Guarantee
All products supplied by the seller benefit from the legal guarantee of conformity provided for by articles L.217-4 et seq. of the Consumer Code and the legal guarantee provided for in articles 1641 et seq. of the Civil Code.
When acting under the legal guarantee of conformity, the consumer:
Benefits from a period of 2 years from the delivery of the goods to act;
Can choose between repair or replacement of the goods, subject to the cost conditions provided for by article L.217-9 of the Consumer Code;
Is exempt from providing proof of the existence of the lack of conformity of the goods during the 6 months following the delivery of the goods. This period is extended to 24 months from March 18, 2016, except for second-hand goods.
The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.
The consumer may decide to implement the guarantee against hidden defects of the sold item within the meaning of article 1641 of the Civil Code and in this case, they can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.
8. Limitation of Liability
In accordance with the texts in force, ruike.fr is not responsible for the non-performance or improper performance of the contract which would be attributable either to the consumer, or to the insurmountable and unforeseeable act of a third party to the contract, or to a case of force majeure.
9. Withdrawal
INFORMATION CONCERNING THE EXERCISE OF THE RIGHT OF WITHDRAWAL
Right of withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days.
The withdrawal period will expire fourteen days after the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or email). You may use the model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back or hand over the goods to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

10. Legal information
Personal information relating to the customer is essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the "Informatique et Libertés" law, the processing of personal information relating to customers has been declared to the National Commission for Information Technology and Liberties (CNIL).
The customer has (article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning them, which they can exercise with ruike.fr. Furthermore, ruike.fr undertakes not to communicate, free of charge or for consideration, the contact details of its customers to a third party.
11. Data protection commitment
In accordance with the provisions of law no. 98-536 of July 1, 1998, transposing into the intellectual property code Directive 96/9/EC of March 11, 1996, concerning the legal protection of databases, ruike.fr is the producer and owner of all or part of the databases comprising this site. By accessing this site, the client acknowledges that the data comprising it are legally protected, and, in accordance with the provisions of the aforementioned law of July 1, 1998, undertakes in particular not to extract, reuse, store, reproduce, represent or retain, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or a qualitatively or quantitatively substantial part of the content of the databases appearing on the site to which they are accessing.
12. Applicable law
This contract is subject to French law.
